Dallas BA Priority Legislation Approved by Legislature

HB 852, a Dallas BA and Texas Association of Builders priority bill, cleared its final hurdle in the legislature on May 8 when the Texas Senate voted approval. The bill, which previously passed the Texas House in April, prohibits municipalities from considering the value of a dwelling or the cost of constructing or improving a dwelling to determine the amount of permit or inspection fees charged. The bill also prevents municipalities from requiring disclosure of information related to the value of or cost of constructing or improving a residential dwelling as a condition for obtaining a building permit, except as required by the Federal Emergency Management Agency for participation in the National Flood Insurance Protection Agency.

The legislation was sponsored by Rep. Justin Holland (R- Heath) and Sen. Pat Fallon (R-Prosper).  Dallas BA commends these legislators for carrying the bill.

HB 852 has been sent to the Governor and awaits his decision for signature.
