Dallas BA Weighs In on Heath Tree Ordinance
Dallas BA, on Aug. 4, offered public comments to the City of Heath’s Planning & Zoning Commission citing concerns with the city’s proposed tree preservation ordinance amendments.
Among the concerns stated, Dallas BA cited:
- The need to provide a more reasonable definition for a “Protected Tree”;
- The importance of including language in the ordinance that references credits for replacement trees that are required by state law;
- The need to bring the ordinance in alignment with state law that prohibits a requirement for an existing residence to pay a tree mitigation fee when the tree is less than 10-inches in diameter at breast height; and,
- A recommendation for the inclusion of a Buildable Area exception that recognizes the realities of construction. The comments were submitted via letter as that is the only option Heath is currently allowing.
Dallas BA has since communicated our concerns to the Heath City Council, having sent a letter detailing recommendations ahead of the city council hearing that was scheduled for August 25.
